Evidence for
The $6,000 Payment Behind Ohio State’s Vacated Seasons
Companion notes
Ohio State’s 1999–2002 men’s basketball infractions and Jim O’Brien’s firing
This provenance companion identifies which court filings, NCAA actions, university notices, and contemporary reporting actually establish the core facts in the Ohio State men’s basketball case. It also shows where the documents converge, where they come from the same reporting chain, and what remains unproven about motive and internal decision-making.
Judicial and institutional records: what they can prove
The strongest provenance for the coach’s hiring, the termination notice, and the contract language comes from the Ohio Court of Claims opinion and the related appellate decision. Those judicial records are primary because they quote the university’s notice, identify Section 5.1(a), and anchor the case in a legally reviewable document rather than in retrospective reporting. They also separate what was asserted in the notice from what later litigation argued, which is crucial in a case where the basis for termination was itself contested. [S1], [S6]
The NCAA’s own case report and news release are the authoritative records for the sanction package: three years’ probation, vacatur of the 1999–2002 tournament results, and a show-cause order against O’Brien. The Ohio State press release confirms the university’s self-imposed sanctions, but it is not independent of the institution’s defensive posture. Together these records establish consequences; they do not independently resolve the underlying intent behind the payment to Radojevic’s family. [S8], [S11], [S13]
Contemporary reporting and where it overlaps the official record
The Associated Press dispatches, as published in regional outlets, are the best contemporaneous public reporting on the $6,000 payment and the firing date. They are independent of the university and NCAA, but they draw on the same live controversy and therefore overlap heavily in facts already later formalized in court and NCAA records. WOSU’s 2006 report and Inside Higher Ed’s analysis confirm the sanction package from different editorial vantage points, giving the same outcome through separate news organizations rather than a single reporting chain. [S3], [S4], [S5], [S9]
The Columbus Dispatch’s 2019 reference piece is useful as a historical marker, not as fresh evidence. It reflects the afterlife of the vacatur: a once-celebrated Final Four run remained part of memory, but no longer of the official statistical ledger. That later reference matters because it shows how the NCAA sanction changed the formal status of the 1999–2002 achievements without adding new proof about the underlying violations. [S10], [S13]
What remains contested in the documentary trail
The central unresolved issue is motive. The contemporaneous AP reporting, the judicial opinions, and the NCAA’s own documents all treat the Radojevic payment as the trigger event, but none of them directly proves that it was made to buy recruiting advantage. O’Brien’s humanitarian explanation appears repeatedly, and the official sanctions show a rules violation, yet the available records stop short of a direct documentary confession or an independent finding that specifically establishes quid pro quo intent. [S1], [S3], [S9], [S13]
Claim provenance
| Claim | Supporting records | Independence | Qualification |
| C1 | [S6] | Ohio Court of Appeals | This is the hiring date stated in the appellate opinion; it does not address any prior employment elsewhere. |
| C2 | [S5], [S6], [S10] | Associated Press, Ohio Court of Appeals, dispatch.com | The sources report the 1999 season and Final Four appearance, while later NCAA action vacated the official record. |
| C3 | [S1], [S3], [S5], [S13] | Ohio Court of Claims, Associated Press, NCAA (News) | The sources describe the payment as a loan or cash payment; they also note O’Brien said it was for humanitarian reasons. |
| C4 | [S3], [S8], [S13] | Associated Press, The Ohio State University, NCAA (News) | The sources establish the termination date; they do not establish the full internal decision process beyond the cited notices and reporting. |
| C5 | [S1], [S6] | Ohio Court of Claims, Ohio Court of Appeals | This is a contract-notice fact from the court record, not an independent finding that the court accepted the notice theory. |
| C6 | [S4], [S9], [S13] | WOSU Public Media, Inside Higher Ed, NCAA (News) | The probation period is reported as beginning March 10, 2006 and lasting three years. |
| C7 | [S9], [S13], [S10] | Inside Higher Ed, NCAA (News), dispatch.com | The sources say the team’s records were vacated for those tournaments; later reference pieces describe the official recognition consequences. |
| C8 | [S13], [S11], [S12], [S9] | NCAA (News), NCAA (Infractions Appeals Committee), NCAA (mirror copy), Inside Higher Ed | The length and start date shifted on appeal and remand, but the existence of the penalty is consistent across NCAA records. |

Evidence assessment
The captured record establishes a real NCAA infractions case, not a standalone criminal scandal: Ohio State hired Jim O’Brien in 1997, reached the 1999 Final Four, later discovered and reported a $6,000 payment tied to recruit Aleksandar Radojevic, fired O’Brien in 2004, and then accepted NCAA probation, vacatur of 1999-2002 tournament records, and show-cause penalties after the NCAA found additional extra-benefit and academic-fraud violations involving Boban Savovic.
